According to the doctrine and jurisprudence of the Supreme Court, the agency's right to collect its fees generally arises upon the conclusion of the property purchase contract. Regarding the percentage, it is indicated that commissions are typically between 3% and 5% plus VAT of the final sale price, depending on the negotiation and the services provided. The legality of double brokerage in Spain allows agencies to charge both the seller and the buyer, provided there is consent and services are offered to both.
Consumers have avenues to file a complaint, such as going to the competent authorities or the courts, in the event of improper fees being charged.
